In response to the pandemic, the Ontario government passed changes to the Employment Standards Act, including the adding of a special leave of absence. We are now starting to see court cases dealing with temporary layoffs as a result of the pandemic and constructive dismissal under the common law. An employer must proceed with caution if they are forced to stop an employee’s work and be aware of the liability associated with their actions. To help us clarify the legalities is Jonathan Borelli.
